A prerequisite of being able to obtain child custody, visitation or child support is that the child needs to have a legal father.

A legal father is someone who may have has signed the birth certificate of the child, has registered as the father with the New York State Putative Father Registry or was married to the mother at the time the child was conceived.

If a legal father has not been established, you will need to have a legal father declared and that can be done through the filing and prosecution of a paternity petition.

Child Abuse And Neglect

Fariah has extensive experience helping parents defend against child abuse and neglect proceedings that are filed by the Administration of Children’s Services, New York City’s Child Welfare Agency. Having worked for the agency, she has unique insights as to how the agency operates and seeks to prove their cases at trial.

Fariah has experience with hundreds of hearings under Article 10, the law that governs Child Abuse and Neglect cases. She has had such cases that were filed against her clients dismissed.

In other cases, she has fought to ensure that ACS does not wrongfully remove children from their parents while cases are pending. If children have been wrongfully removed, Fariah has asked for immediate emergency hearings and has fought until families were reunited.

Under Article 8 of the Family Court Act, individuals that are seeking protection from family violence and disturbances can obtain orders of protection in Family Court.
