Meaningful Legal Help For Family Law

Fariah Amin is a family law and divorce attorney focusing on custody, visitation, orders of protection, cases involving child protective services, child support, and divorce in New York. At Amin Legal Firm, P.C., we provide experienced legal guidance and help with the following areas:

Child Custody And Visitation

We have extensive experience helping clients obtain custody of their children. Through the use of forensic experts and discovery tools, Amin Legal Firm, P.C., will assist you in proving why you are the optimal parent to obtain custody of your children.

Fariah has worked with individuals to obtain full and sole custody of their children and has also negotiated joint-custody agreements in cases where appropriate. We understand that there is nothing more important than your children. If you need an attorney to help protect your children against an unfit or abusive parent, we are here to help.

If you find yourself in a position where the custodial parent is trying to unduly restrict and limit your access to your children, we will fight to ensure that you have regular and meaningful visitation and contact. It is almost always in the best interest of children to have both of their parents play an active role in their lives.

Not only can we help the non-custodial parents obtain meaningful visitation with their children but we will fight to make sure you have access to records as they relate to the health and education of your children.

Child Support, Including Enforcements And Violations

Our firm has experience helping individuals obtain child support awards and have past awards modified. We can also help you enforce a child support order through enforcement petitions, helping you establish arrears and obtain money judgments for what is owed.

We also provide assistance in the filing and prosecution of Violation petitions if you are seeking incarceration due to failure to comply with an order of support.

Paternity

A prerequisite of being able to obtain child custody, visitation or child support is that the child needs to have a legal father.

A legal father is someone who may have has signed the birth certificate of the child, has registered as the father with the New York State Putative Father Registry or was married to the mother at the time the child was conceived.

If a legal father has not been established, you will need to have a legal father declared and that can be done through the filing and prosecution of a paternity petition.

Child Abuse And Neglect

Fariah has extensive experience helping parents defend against child abuse and neglect proceedings that are filed by the Administration of Children’s Services, New York City’s Child Welfare Agency. Having worked for the agency, she has unique insights as to how the agency operates and seeks to prove their cases at trial.

Fariah has experience with hundreds of hearings under Article 10, the law that governs Child Abuse and Neglect cases. She has had such cases that were filed against her clients dismissed.

In other cases, she has fought to ensure that ACS does not wrongfully remove children from their parents while cases are pending. If children have been wrongfully removed, Fariah has asked for immediate emergency hearings and has fought until families were reunited.

Administrative Hearings–Family Offense

Under Article 8 of the Family Court Act, individuals that are seeking protection from family violence and disturbances can obtain orders of protection in Family Court.

We have assisted dozens of clients in obtaining orders of protection and have also assisted several individuals who were wrongfully accused defend against family offense petitions. Whether you are seeking an order of protection or are seeking protection from false allegations, Fariah can help you.

Contested And Uncontested Divorces

We can help negotiate fair agreements when you and your spouse have a straightforward divorce. We will advise you if it becomes necessary to go to trial and fight for what you deserve.
